Hal ini diatur dalam Permenaker 4\/1994, dimana dinyatakan pembagian THR diberikan kepada pekerja dengan masa kerja minimal 3 bulan.<\/p>\n<p style=\"text-align: justify;\">Menurut peraturan yang lama, Ketentuan besarnya THR berdasarkan peraturan THR Keagamaan tersebut adalah bagi pekerja\/buruh yang bermasa kerja 12 bulan secara terus menerus atau lebih maka mendapat THR sebesar satu bulan upah.\u00a0 Selain itu,\u00a0 disebutkan pula setiap pekerja\/buruh yang telah mempunyai masa kerja 3 (tiga) bulan secara terus-menerus atau lebih maka berhak mendapatkan THR secara proporsional.<\/p>\n<p style=\"text-align: justify;\">Berita baik, Menteri Ketenagakerjaan (Menaker) M. Hanif Dhakiri telah menerbitkan Peraturan Menteri Ketenagakerjaan (Permenaker) No. 6\/2016 tentang Tunjangan Hari Raya (THR) Keagamaan Bagi Pekerja \/ Buruh di Perusahaan. Dalam Permenaker yang diundangkan pada 8 Maret 2016 itu disebutkan, pekerja dengan masa kerja minimal satu bulan kini berhak mendapatkan THR. Tentu saja besarannya dihitung secara proporsional sesuai dengan masa kerja.<\/p>\n<p style=\"text-align: justify;\">\u201cDalam peraturan yang baru, pengusaha wajib memberikan\u00a0 THR Keagamaan kepada pekerja\/buruh yang telah mempunyai masa kerja 1 bulan secara terus menerus atau lebih. Hal itu berlaku bagi pekerja yang memilki hubungan kerja, termasuk yang bekerja\u00a0 berdasarkan\u00a0 perjanjian kerja waktu tidak tertentu\u00a0 (PKWTT) maupun\u00a0 perjanjian kerja waktu tertentu, (PKWT)\u201c kata Hanif. THR Keagamaan merupakan pendapatan non upah yang wajib dibayarkan oleh pengusaha kepada pekerja\/buruh atau keluarganya selambat-lambatnya 7 hari sebelum Hari Raya Keagamaan atau dapat ditentukan lain sesuai dengan kesepakatan pengusaha dan pekerja yang dituangkan dalam peraturan perusahaan atau perjanjian kerja bersama (PKB).<\/p>\n<p style=\"text-align: justify;\">Sedangkan Pekerja\/buruh yang bermasa kerja 1\u00a0 bulan secara terus-menerus tetapi kurang dari 12 bulan, diberikan\u00a0 secara proporsional, dengan menghitung :\u00a0 jumlah masa kerja dibagi 12 (dua belas) bulan dikali satu bulan upah.<\/p>\n<p style=\"text-align: justify;\">Dalam peraturan tersebut, diatur juga mengenai pengawasan pelaksanaan pembayaran THR yang dilakukan oleh pengawas ketenagakerjaan serta adanya sanksi berupa denda dan sanksi admisnistratif terhadap pengusaha dan perusahaan yang melakukan pelanggaran.
